These Terms and Conditions govern all contracts between

(hereinafter "MalMagic" or "Provider") and users of the MalMagic web application (hereinafter "Service").
Deviating or supplementary terms of the user do not form part of the contract unless the Provider expressly agrees to them in writing.
Registration on the platform constitutes an offer by the user to enter into a usage agreement. The contract is concluded upon confirmation of registration by email from the Provider.
For paid subscriptions, the contract is concluded upon successful completion of the payment process via Stripe. The Provider reserves the right to decline registration without giving reasons.
MalMagic provides an AI-based web application that enables users to generate personalised colouring pages from uploaded photos. The Service includes:
The Provider does not guarantee any specific image quality or AI generation result. A service availability (uptime) of 99% (annual average) is aimed for but not guaranteed.
Use of the Service requires registration. Users must be at least 18 years old or acting with the consent of a parent or guardian. Business users confirm that they are authorised to represent the business.
Each user may only create one account. Login credentials are confidential and must not be shared with third parties. The user is responsible for all activities that occur under their account.
In the event of suspected misuse, MalMagic is entitled to temporarily suspend the account.

All prices are final prices inclusive of applicable VAT. Paid subscriptions are billed monthly in advance via Stripe. Unused credits for a given month expire at the end of that month and are not carried over.
MalMagic reserves the right to change prices. Price changes will be communicated to users by email at least 30 days before they take effect.
Paid subscriptions run for an indefinite period and may be cancelled by the user at any time with effect from the end of the current billing period (month). Cancellation is made via account settings.
MalMagic is entitled to cancel paid subscriptions with 30 days' notice to the end of a month. The right to extraordinary termination for good cause remains unaffected.
Good cause includes in particular: serious breaches of these Terms, misuse of the Service, or payment arrears exceeding 14 days after a reminder.
MalMagic grants the user a simple, non-transferable right to use the Service for private and commercial purposes for the duration of the contractual relationship.
For generated colouring pages, MalMagic grants the user a simple, time-unlimited right of use. The user is entitled to use, print and share the colouring pages for private and non-commercial purposes.
Resale or commercial exploitation of generated colouring pages is prohibited without the express written consent of MalMagic.
The user undertakes to:
In the event of a breach, the user is liable for all resulting damages and shall indemnify MalMagic against third-party claims.
MalMagic is liable without limitation for damages resulting from injury to life, body or health, and for damages caused intentionally or through gross negligence.
In cases of ordinary negligence, MalMagic is only liable for the breach of material contractual obligations (cardinal obligations), limited to the typical damage foreseeable at the time of contract conclusion.
Further liability is excluded. MalMagic is not liable for AI-generated content that does not meet the user's expectations, for temporary unavailability of the Service, or for data loss where the user is responsible for adequate data backup.
The processing of personal data is governed by the Privacy Policy, available at /datenschutz, which forms part of these Terms.
MalMagic reserves the right to amend these Terms with at least 30 days' notice. Amended Terms will be communicated to the user by email.
If the user does not object to the amended Terms within 30 days of receiving the notification, the amended Terms are deemed accepted. The notification will expressly draw attention to the right of objection and the consequences of silence. In the event of an objection, MalMagic is entitled to terminate the contractual relationship with effect from the date the changes take effect.
MalMagic reserves the right to extend, restrict or discontinue the Service at any time, provided this is reasonable for the user and does not violate material contractual obligations. Significant changes will be communicated to the user in a timely manner, with at least 30 days' advance notice.
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the commercial purpose of the invalid provision.
Ancillary agreements, amendments and supplements to this contract require written form. This also applies to the waiver of the written form requirement.
These Terms are governed by Greek law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, mandatory consumer protection provisions of their country of residence remain unaffected.
The place of jurisdiction for all disputes arising from this contract with merchants or legal entities under public law is Serres, Greece.
